Allahabad High Court: Judges often convict innocent defendants just to avoid Supreme Court proceedings

The Court therefore directed its clerk to locate the clerk, who may now be retired, and to send him a copy of the judgment so that he would know that he had not made any error in deciding the case (other than the conviction under Section 506).

The trial judge had earlier justified his decision to acquit the accused on the ground that the notice was served on him only to damage his reputation and service. The Supreme Court agreed with his reply and said:

“He did not err in deciding the case and acquitting the appellants on charges under Sections 498-A, 304-B, 201 IPC and Section ¾ of the DP Act. We have come to the same conclusion. Further, we have found that the conviction and sentence imposed on the appellants under Section 506 Part 1 IPC were also unjustified and may have been ordered only to protect the court from unwanted communications such as those sent by the learned Single Judge to the District and Sessions Judge.”
