The decision of the Supreme Court of Rajasthan

The case revolved around a transaction in which Shiv Kumar Mandovra sold guar gum to Ram Kishore Jhanwar and his son Narendra Jhanwar. The seller claimed that the buyers took delivery of the goods but did not pay for them. On investigation, it was found that the goods worth Rs 2,554,807 were in the possession of Rana Ram, who had purchased them from Narendra Jhanwar. Rana Ram argued that he was an innocent buyer and had paid for the goods in full.

Though it was a civil dispute, an FIR was filed under sections 406 and 420 of the IPC. The court held that it was an abuse of power by the police with the intention of helping the complainant recover his debts rather than addressing any actual criminal wrongdoing.
