Shocking claim from elementary school teacher arrested for kissing student

The suspended Wisconsin elementary school teacher accused of having sex with an 11-year-old student has called for the charges against her to be dropped.

Madison Bergmann, 24, was arrested in April after the fifth-grader's parents reported her to the school administration and police at River Crest Elementary School.

On Thursday, Bergmann, who was left by her fiancé because of her repulsive behavior, claimed that charges against her should be dropped because the boy's text messages were not specific enough to prove how they had touched each other, the New York Post reported.

Bergmann, dressed in light gray pants and a black shirt, appeared in court with her father and appeared dejected after a judge denied her motion.

During the motion hearing, more intimate messages between the disgraced teacher and her student came to light. She allegedly said she wanted to “lick” the boy's abs and enjoyed touching his chest.

In one of the recently released text messages, the boy allegedly wrote: “You touched my chest many times.”

Her attorney, Joseph Tamburino, argued that his client's behavior did not mean that she sexually harassed him because the fifth-grader used the word “breast” when describing their contact with each other.

“This motion is based on the assumption that in one particular area, namely that of 'sexual contact in the intimate area,' there is insufficient suspicion for the complaint,” Tamburino said.

“Under Wisconsin law, there must be touching of an intimate area for sexual contact to occur.”

“What are these body parts? A person's breast, buttocks, anus, groin, scrotum, penis, vagina or mons pubis. The law does not say it is the 'breast' or 'chest area,'” he added.

The judge quickly concluded that her lawyer's arguments would not make him change his mind about the charges against Bergmann.

“It would be absurd to ask a child to use the same language that the state parliament has chosen for our laws,” the judge replied.

The judge then read out more text messages between the 24-year-old and the 11-year-old. One of them read: “I love having my hand on your chest. I could feel your heart beating so hard, hahaha,” Bergmann is said to have written to the boy.

On April 29, the alarm was raised when the boy's mother overheard a telephone conversation between Bergmann and the victim.

On April 29, the alarm was raised when the boy's mother overheard a telephone conversation between Bergmann and the victim.

The student then reportedly said: “Haha, it happened so quickly. I was so surprised and I loved it because you just kept kissing me.”

“As everyone was cleaning up after the reading, I stood at the front and so did you, and I touched your breast,” she reportedly wrote.

“When I grabbed your shirt and pulled you to me, oh my goodness… I want to lick your abs, haha.”

The judge ultimately decided that the word “breast” did not exempt Bergmann from the charge of sexual assault.

Although Bergmann was initially charged with first-degree sexual abuse of a child, she was charged with additional charges, according to court records, including using a computer to facilitate a child sex crime, exposing a child to harmful descriptions, two counts of child enticement and five counts of sexual misconduct by school personnel.

The alarm was raised on April 29 when the boy's mother overheard a telephone conversation between Bergmann and the victim. His father confiscated his phone and discovered sexually explicit text messages in it.

In a text message, Bergmann told the boy that she “just wanted to grab him by the face, push him to the ground and make out with him,” the complaint states.

In another text message, she reportedly wrote: “I almost kissed you today when you were on the floor, but your belly distracted me.”

The child's father subsequently handed over printed text messages between Bergmann and his son to law enforcement and the administration.

During her police interview, she told authorities that the victim's mother allegedly gave her the student's phone number after the family invited her to the Afton Alps ski resort for winter vacation.

When officers searched Bergmann's bag, they found handwritten notes from the two in a folder printed with the victim's name, according to the charging documents.

“In her notes, she tells him that she loves him, wants to kiss him, that he turns her on, and that she is obsessed with him,” the complaint states.

In a letter, Bergmann reportedly wrote: “One of my cousins is in the 5th grade and I can't imagine a man talking to her the way we do.” “I know we have a special relationship and I love you more than anyone else in the world, but I have to be the adult here and stop.”

Police also spoke to the little boy, who, according to the complaint, “made comments about how he really liked her, trusted her, felt weird, but also enjoyed it.”

When questioned about the text message exchange between her and the student, Bergmann invoked her right to an attorney, the documents say. She was subsequently arrested.

After her arrest, she was suspended from her teaching position and taken into custody the same day.

It later emerged that she had allegedly moved his desk out of sight so that she could massage his legs during class.

The fifth-grader told investigators that Bergmann rubbed his thighs and calves during reading time, according to a criminal complaint filed in St. Croix District Court.

According to charging documents, the boy also told investigators that they had kissed several times in the classroom since March, that Bergmann was his first kiss, and that they had secretly fondled each other.

The former teacher was due to marry her partner Sam Hickman in July, but plans were scrapped after Hickman described his now ex-fiancée's “shitty behaviour”.

“It has been postponed indefinitely,” a friend of the couple told the New York Post.

“He's really hurt. I don't talk about it much, I'm just like, 'This sucks.' He's still in shock.”

“Not only did she cheat on him, she did so with a small child.”

She pleaded guilty to all charges and is expected to appear in court for her preliminary hearing on October 7. If convicted, Bergmann faces up to 178 years in prison.
