Diddy hits back against 0 million default judgment … claiming he never received the lawsuit

Just days after Diddy was hit with a $100 million default judgment, the troubled music mogul is trying to fight it.

Derrick Lee Cardello-Smith sued the 54-year-old rapper for $100 million, claiming he was drugged and sexually assaulted at a party in 1997.

Since Diddy neither officially responded to the lawsuit nor attended a virtual hearing on Monday, the judge entered a default judgment against the rapper.

Starting October 1, Diddy would have to pay monthly installments of $10 million to Cardello-Smith.

However, Diddy filed an emergency motion to overturn the ruling on Thursday, claiming, among other things, that he never received the lawsuit.

The music mogul's documents say he hasn't known how to handle the matter since news outlets reported on it.

His lawyers also strongly deny any wrongdoing and claim that the allegations are “at first glance implausible and completely fabricated.”

The lawyers also argue that even if these charges were true, the statute of limitations expired 17 years ago.

Diddy's team claims the lawsuit is invalid because the man filing it is a convicted rapist and he has filed invalid lawsuits several times in the past.

The lawsuit alleges that during a party in 1997, Cardello-Smith and Diddy both had sex with a group of women and that at one point he felt Diddy's hand touching his butt.

He also claims Diddy slipped something into his drink and when he woke up, Diddy was having sex with another woman and claims he said, “I did that to you too.”

Cardello-Smith, who is currently serving a sentence in a Michigan prison, obtained a restraining order against Diddy in August.

He presented documents proving that Diddy had visited him in prison and claimed that he had offered Cardello-Smith $2.3 million to drop the charges against him.

Diddy's lawyer Marc Agnifilo told DailyMail.com: “This man [Cardello-Smith] is a convicted felon and sex offender who has been convicted of 14 counts of sexual assault and kidnapping over the past 26 years.

“His resume now includes court fraud from prison, as Mr. Combs has never heard from him, let alone been served with a lawsuit. Mr. Combs hopes this verdict will be overturned quickly.”

Last month, Combs filed a motion to dismiss a $30 million lawsuit filed by record producer Rodney “Lil Rod” Jones, who had sued him for persistent groping and possible drug-induced rape.

Jones filed suit in February, just weeks before two of Combs' homes were raided by federal agents as part of a sex trafficking investigation.

Jones claimed he was instructed to recruit prostitutes and have sex with them for the star's pleasure, and he has hundreds of hours of video footage documenting Combs' “serious illegal activities.” Diddy has denied all allegations of wrongdoing.
