Bail set at 0,000 for man accused of sexually abusing young girl in Bothell home

EVERETT, Washington.After several days on the run, a man was brought to court for allegedly sneaking into a random house and sexually abusing a young girl.

Kevin Montoya appeared virtually for a probation hearing in Snohomish County District Court on Tuesday. A judge set his bail at $500,000.

Investigators with the Snohomish County Sheriff's Office said Montoya broke into a family's home at the Bailey Farm Apartments in Bothell early Friday morning.

Officials believe Montoya chose the apartment at random and entered the house through an unlocked door. According to court documents, Montoya entered the house through an unlocked sliding door near the 11-year-old girl's bedroom.

Montoya is suspected of sexually abusing the young girl. According to court documents, Montoya touched the girl's private areas over her clothing and asked the child if she would touch him. Investigators said the suspect took off when another child in the room woke up and realized what was happening.

Court documents say Montoya left the house through the sliding door and that both children immediately notified a parent in the house and called 911.

Investigators searched for Montoya for days. According to court documents, several images from surveillance cameras, including those from the apartment complex, were used to identify Montoya. The suspect was tracked down and arrested at his sister's home in Snohomish on Monday. He was taken to the Snohomish County Jail.

During the probable cause hearing, prosecutors described Montoya as a “significant threat to the community” because he has a “highly troubling history of sexual abuse.”

“The defendant has demonstrated beyond a doubt that he poses a significant threat to the community and that the charges contained in this warrant are justified. The nature of this crime is extremely predatory,” the prosecutor said.

Prosecutors requested that Montoya's bail be set at $750,000, fearing that the suspect might attack again if a high bail was not set.

“The defendant has a highly troubling history of engaging in criminal sexual offenses dating back to October 2023. This incident represents a significant escalation of his behavior, which has been previously documented. I would like to note that the defendant had an arrest warrant for an incident on December 30, 2023, in which he trespassed on neighboring properties and investigated three different residences,” the prosecutor said.

During the probable cause hearing, a public defender requested a competency evaluation to determine whether Montoya understood the charges against him. Before the hearing, the public defender said a request had been made for an order under RCW 10.77, a Washington state law that governs proceedings for the criminally insane. RCW 10.77 is reviewed in part by Western State Hospital, an adult psychiatric facility in Lakewood. A judge denied the request for RCW 10.77.

The judge set Montoya's bail at $500,000. He is charged with first-degree burglary and second-degree child abuse.

The court ordered that Montoya not have contact with minors, including the victim, stay away from the apartment complex and be prohibited from carrying weapons.
