The Supreme Court on Thursday reserved its verdict on Delhi Chief Minister Arvind Kejriwal's petition seeking his release from custody in connection with tax policy.

The top court, comprising Justices Surya Kant and Ujjal Bhuyan, heard arguments of Additional Solicitor General SV Raju, representing the Central Bureau of Investigation (CBI), and senior advocate Abhishek Manu Singhvi, representing Kejriwal.

What happened during the hearing?

During the hearing before the Supreme Court, the CBI, which arrested Kejriwal on June 26, questioned the admissibility of the chief minister's bail application.

The agency informed the Supreme Court that Kejriwal was involved in the corruption case related to the

“He has approached the Delhi High Court directly without going to the district court. Under Section 439 of the Code of Criminal Procedure (CrPC), both have concurrent jurisdiction. My preliminary objection is that he has to go to the trial court first,” PTI quoted Deputy Attorney General SV Raju, appearing for the CBI, as saying.

According to the ASG, the agency did not serve notice under Section 41A of the Criminal Procedure Code on Kejriwal as he was already in judicial custody.

Kejriwal's lawyer says CBI made an 'insurance arrest'

Kejriwal's lawyer Abhishek Manu Singhvi argued before the Supreme Court that the Prime Minister was a constitutional functionary and posed no “risk of absconding”.

He added that the CBI made an “insurance arrest” after the Supreme Court granted him interim bail in May. Singhvi also argued that arrests need to be regulated and one should not be “trigger-happy”.

“What started in August 2023 led to his arrest in the money laundering case in March this year,” the senior lawyer said, adding that the Supreme Court and a court of first instance had already granted him bail.
