Man invokes 'cohabitation agreement' in assault case to get bail before arrest | Nation

PTC Newsroom: In an effort to obtain pre-arrest bail in a sexual assault case brought by his partner in Mumbai, a 46-year-old man submitted a “cohabitation agreement” in which he claims the two had agreed not to file sexual harassment cases against each other.

On August 29, the court granted him bail in the rape case.

However, the 29-year-old woman who sued him told a Mumbai court that the signature on the document was not hers.

The woman works as a geriatric nurse, while the accused is a government official, according to police, who are currently investigating the alleged relationship.

The woman stated that her partner had promised to marry her and had raped her several times during their life together.

The defendant's lawyer called the case a fraud.

“The complainant has been falsely accused in this case. He is a victim of circumstances. They were in a marriage-like relationship. The agreement shows that both of them had consented to a relationship. The agreement was made and the woman signed it. The agreement shows that both of them had consented to a relationship,” said Sunil Pandey.

According to the seven-point agreement, the two will stay together from August 1, 2024, to June 30, 2025. The second provision stipulates that during this time, they will not file any sexual harassment charges against each other and will spend their time together peacefully.

According to the third sentence, the woman lives with the man in his apartment and can leave him at any time with one month's notice if she considers his behavior to be inappropriate.

The fourth sentence states that the woman's relatives are not allowed to visit her at home while she is living with him.

According to the sixth sentence, the woman may not harass the man or inflict mental anguish on him.

The sixth paragraph states that the man should not be held responsible if the woman becomes pregnant during this period. The eighth paragraph states that the woman will be held responsible if the harassment causes the man psychological stress and destroys his life.
