Michigan Supreme Court largely upholds election challenge rules

The Michigan Supreme Court on Wednesday upheld much of the state's guidance regarding election challengers in a narrow decision.

The case concerned a manual first published in 2022.

It required objectors to submit a single application to be admitted and to raise their concerns through a designated contact person. It also detailed what types of objections were considered “admissible”.

The lawsuit sought to reverse these changes, arguing that the guide was a “rule” and should have been subjected to the state’s official legislative process.

However, the state Supreme Court found that the manual largely fell under the exceptions to that procedure that apply when an agency interprets the law by means of a guideline.

However, the Court struck down parts of the Guide that allow a challenge liaison officer to decide on the inadmissibility of a challenge on the spot without recording it.
