Woman files lawsuit against Silver Dollar City and Herschend Entertainment over October 2022 train derailment

NEAR BRANSON, MO (KY3) – A passenger on a train derailed in Silver Dollar City in October 2022 has filed a lawsuit.

Rebecca Everhart sued Silver Dollar City and Herschend Family Entertainment Corporation for negligence. The suit alleges that Silver Dollar City failed to maintain the train, which led to its derailment. Everhart reported back injuries and post-traumatic stress disorder as a result of the derailment.

The Herschend family filed a motion to dismiss the lawsuit. A judge has not yet ruled on that motion.
