West daycare worker arrested after allegedly injuring child while attempting to restrain him

WACO, Texas (KWTX) – A west daycare worker was arrested for injuring a child when she reached out her arm and touched his chest while attempting to restrain him, an affidavit states.

60-year-old Mildred Franks is accused of negligently injuring a child.

The affidavit states that the Department of Family and Protective Service/Child Protection Services contacted West police on August 5 because a West daycare reported an injury to a child.

Police launched an investigation into the incident and determined that Franks was an employee of the daycare and was in charge of children ages three to four at the time of the incident, the affidavit states.

In addition, police confirmed that the victim was four years old and enrolled in daycare, the affidavit states.

Video evidence obtained by police on Aug. 2 shows Franks caring for six children at the facility and then extending her right arm to restrain the victim, the affidavit said.

The affidavit states that Frank's hand can be seen touching the victim's chest and that she is clenching her fists.

The victim can then be seen clutching his chest, falling to the ground and screaming in pain, the affidavit states.

The victim moved to one side of the room while still holding his chest and Franks was heard saying, “Don't run away,” an affidavit states.

Police received pictures from the victim's mother and the daycare director showing the victim's injuries. The injuries include two bleeding scratches, an affidavit states.

An affidavit states that the victim's mother told police during an interview that she had noticed Frank's aggressive behavior before and that she only became aware of the incident with her child when the child told her that his chest hurt.

The daycare director told police that additional video evidence indicated the victim made several attempts to show Franks his injuries, the affidavit states.

According to the affidavit, Franks made no attempt to help the victim or inform other employees.

Franks was interviewed by police on August 8. She admitted to physically touching the victim to prevent her from running away, but denied intentionally hurting the victim.

An affidavit states that Franks admitted that her hand may have clenched into a fist when she touched the victim's chest.

Franks was booked into the McLennan County Jail and is being held on $3,000 bail.
