A Harris County Constable's Office deputy involved in a car crash that killed a 28-year-old man has been fired, but no charges have been filed against the officer.

The accident occurred around 1:30 p.m. Saturday in the area of ​​2700 Canal Street when Deputy Rigo Vivar allegedly “crossed traffic and drove the wrong way in the westbound lanes” on his way to work, according to Houston police.

Vivar was driving his private car when the accident killed 28-year-old Ricardo Resendez.

In a statement Monday, Constable Silvia Trevino said Vivar was fired the day after the accident and is no longer employed by the Harris County 6th District Constable's Office.

“We are committed to fully supporting the ongoing investigation by the Houston Police Department and the District Attorney's Office,” she said.

Two days after the accident, no criminal charges have been filed.

A police department spokesman reached by phone Monday instructed Houston Public Media to forward questions about the incident to the office via email, but did not respond to multiple messages seeking comment.

“My sincere condolences go out to the family and loved ones of Ricardo Resendez,” Trevino said. “My heart is broken by their loss, and while there are no words that can bring their loved one back, I want them to know that my thoughts and prayers are with them during this incredibly difficult time.”

In a statement, lawyers for the Resendez family called for charges to be brought in connection with the accident, saying they “want full and complete justice for Ricardo Resendez Jr. and to ensure that something like this never happens to an innocent private citizen again.”
