Fauquier County man dies one week after attack at CVS | News

A Fauquier County man has died after being attacked in the CVS parking lot last week.

Malcolm McIntyre, 78, died Tuesday, a week after he was allegedly attacked by Sonny Sauceda, 40, in the parking lot of CVS at 510 Blackwell Rd. in Warrenton.

At approximately 10:30 a.m. on August 13, emergency responders responded to reports of an altercation involving a man with a brick in the drug store parking lot. They found McIntyre unconscious in the street next to a car, surrounded by bricks.

McIntyre was flown by helicopter to a hospital in Fairfax with head injuries sustained in the fight. McIntyre died of his injuries on August 20.

Sauceda was arrested on the scene by Warrenton police officers on August 13 and charged with aggravated assault. He is being held without bail, according to Warrenton police.

McIntyre's body has been sent to the Virginia State Medical Examiner's Office for an autopsy. The cause of death will be released after the medical examiner's report is completed, the press release said.

According to court documents, Sauceda admitted to the attack at the scene.

“I admit everything,” Sauceda told the arresting officer, according to the indictment. “I attacked this man with a brick of my own volition. I just wanted to hurt him, so I attacked him with a brick. Now, of course, I regret it. I pray that he survives.”

Sauceda had been arrested less than a week earlier, on August 8, after allegedly smashing car windows on the street where he lives.

Warrenton Police Detectives will continue to investigate this case. Evidence collected at the scene has been sent to the Forensics Division for analysis, officials said.

Additional charges are expected to be determined after consultation with the Fauquier County District Attorney's Office and pending the findings of the medical examiner's office and forensic science department, officials said.
