Marjorie Taylor Greene calls for the arrest of Fani Willis

Georgia House Representative Marjorie Taylor Greene called for the arrest of Fulton County District Attorney Fani Willis for failing to comply with a subpoena.

Willis is leading the Georgia election interference case against former President Donald Trump and is simultaneously being investigated by a Republican-led committee of the Georgia State Senate.

The Georgia Senate Special Investigation Committee said it was investigating Willis on “allegations of misconduct … related to potential conflicts of interest and misuse of public funds to enact new laws or amend existing ones and/or alter state budget allocations in order to restore public confidence in the criminal justice system.”

Marjorie Taylor Greene, who was seen leaving the U.S. Capitol on Thursday, September 12, has called for the arrest of Attorney General Willis.

The State Senate Committee requested a subpoena for Willis to appear before the Senate on Friday and give a “sworn statement.” Willis did not appear, however, citing her disbelief in the legality of the subpoena itself.

Former federal prosecutor Neama Rahmani previously said Newsweek that ultimately the Georgia courts would decide on the legality of the subpoenas, “however, such legislative subpoenas are generally invalid due to the separation of powers.”

Instead of attending the hearing, Willis attended a re-election fundraiser in Washington on Friday, sparking Greene's ire.

Former Governor Roy Barnes, who is currently Willis' attorney, told the Atlanta Journal-Constitution that Willis “will not appear until there is a court decision on the validity of the subpoena.”

Taylor Greene posted two posts on her X account (formerly Twitter) criticizing Willis' decision not to attend the hearing and calling for her arrest.

Her first post read: “Fani Willis believes she is above the law and today defied a subpoena from the Georgia Senate. Her defiance is absolutely unacceptable. There are very serious questions about various possible forms of misconduct.”

“This investigation is all the more urgent given her political stalk of the leading presidential candidate. Fani Willis is NOT above the law.”

Her second post read: “Fani Willis should be arrested for ignoring her subpoena.”

According to the Georgia Code of 2023, passed by the Georgia General Assembly, failure to comply with a subpoena may result in punishment for contempt of court, and the person failing to comply may be punished by a fine not exceeding $300 or imprisonment not exceeding 20 days, or both.

If Willis does indeed fail to comply with a subpoena, the Georgia General Assembly could comply with Taylor Greene's request for her arrest.

This is not the first time Willis has been at the center of the Georgia election tampering case. In March, Nathan Wade, the former Fulton County special prosecutor who was involved in the prosecution of the election tampering case, was forced to resign from the case after it came to light that he and DA Willis were once romantically involved.
