LSK takes legal action over police brutality during 2023 protests

The Law Society of Kenya (LSK) has filed a petition on behalf of 28 victims of police brutality who sustained injuries or died during the 2023 high cost of living protests. The petition was filed at the Kisumu High Court and highlights the severe suffering endured by people from Kisumu, Migori and Homa Bay counties as a result of police excesses during the demonstrations.

The protests erupted in 2023 after subsidies on essential goods such as maize flour and petroleum were removed, leading to widespread unrest. Kisumu LSK Chairperson Dorcas Oluoch addressed the court, describing the horrific experiences of the victims and demanding justice.

“Our aim is not only to hold accountable those who were directly involved in these atrocities, but also to ensure that those responsible within the police force are held accountable,” Oluoch said. “We demand compensation for the families affected by these tragic events.”

Among the victims is John Ahala, whose son was tragically shot dead during the protests in Nyalenda. In his speech in court, Ahala stressed that justice is needed for his son and other families who have lost their loved ones.

“We saw senior police officers being praised and promoted, which felt like a reward for their actions. Meanwhile, our families are grieving. If we get justice, that will give us some comfort,” Ahala said.

Ruth Kihuria, lawyer at International Justice Mission (IJM) Kenya, highlighted an important aspect of the petition.

“The prayers include that the Inspector General of Police be held accountable for violations of the rights of petitioners. These include cases where persons have been shot, injured or sustained serious fatal injuries,” Kihuria said.

The petition represents a significant legal challenge targeting police brutality and seeking redress for victims and their families. The court's response will be closely watched as it could set a precedent for how similar cases are handled in the future.
