Deadly Buda shooting: Prosecutor says no murder charges filed against man who killed teenager

A man who shot and killed a teenager in Buda earlier this month will not face murder charges, the Hays County district attorney says.

A Hays County grand jury has voted not to indict a 21-year-old man in the shooting death of 17-year-old Erick Alejandro Marin.

On August 5 at approximately 5:17 p.m., Hays County Sheriff's deputies responded to a shooting in a drainage area behind homes in the 800 block of Shadow Creek Boulevard. When they arrived, they found Marin, who had been shot. He later died at the scene.

Videos of the shooting presented to investigators showed two groups of people getting into a fight at the scene. A teenage relative of Marin had gotten into a fight with the 21-year-old man.

During the fight, Marin pulled out a gun and began shooting the man.

Another youth from the other group returned fire, at which point the man grabbed the gun and shot Marin, killing him, the Hays County district attorney says.

Prosecutors said they reviewed the evidence and concluded the shooting that killed Marin was justified under Texas self-defense and defense of a third person laws.

On Wednesday, August 28, the case was presented to the grand jury, which agreed that the shooting was justified.

The public prosecutor's office says that the other youths present and involved may face further charges for their conduct in connection with the incident.
